Anti-doping is often presented as one of sport’s clearest moral frameworks: a unified global effort to protect fairness, integrity and athlete welfare. In reality, it is a system increasingly tested by scientific complexity, political tension and growing scepticism from within the sporting community itself.

Today, those pressures are converging. The World Anti-Doping Agency (‘WADA’) regulatory model – built on strict liability, expanding prohibited lists and universal compliance – is being stretched by geopolitical disputes, inconsistent enforcement and questions over whether its rules remain realistically workable for modern athletes.

As trust in the system is tested from multiple directions, the central question is no longer how anti-doping is enforced, but whether the framework can continue to command legitimacy at all.

In this article, Yasin Patel, Caitlin Haberlin-Chambers and Joshua Brecker explore the challenges faced by the global anti-doping framework in 2026, assessing whether WADA’s three foundational values remain achievable, or whether they now expose the structural limits of the system itself.

The Global Anti-Doping Framework: A Snapshot

Established in 1999, WADA was created as an independent international body to lead a co-ordinated, global response to doping in sport. It is widely regarded as the central authority for harmonising anti-doping policy across jurisdictions, with the stated aim of “developing, harmonising and co-ordinating anti-doping rules and policies across all sports and countries.”

WADA is underpinned by three core values which shape its approach to regulation:
  • Integrity: safeguarding fair competition by ensuring that sporting outcomes are determined by performance rather than prohibited enhancement.
  • Openness: promoting transparency in rule-making, scientific standards and enforcement processes, while encouraging collaboration across the global anti-doping network.
  • Excellence: maintaining rigorous scientific, operational and procedural standards to ensure the system remains responsive to advances in both sport and doping methodologies.
At the heart of WADA’s regulatory architecture is the World Anti-Doping Code (‘the Code’), which functions as the global framework for anti-doping governance. The Code is not a standalone statute but a model framework, requiring adoption and implementation by a wide network of stakeholders, including international sporting federations, national anti-doping organisations, the Olympic Movement, and professional sporting bodies. This structure is intended to ensure consistency in enforcement and interpretation, regardless of sport or jurisdiction, while still allowing for limited local implementation through associated International Standards (such as testing, laboratories, and therapeutic use exemptions).

WADA itself is responsible for maintaining and updating the Code, co-ordinating compliance, and monitoring the effectiveness of anti-doping programmes worldwide. In doing so, it acts less as a traditional regulator and more as a global standard-setter, reliant on co-operation between states, sporting bodies and independent testing authorities to give practical effect to its rules.

Integrity

WADA’s Code of Ethics defines integrity as observing the highest ethical standards and avoiding improper influences and conflicts of interest that may undermine WADA’s independent and unbiased judgment. However, the consistency of that principle has increasingly been questioned.

Strict Liability and Legal Responsibility

A central feature of the anti-doping framework is the doctrine of strict liability. Under this principle, an athlete is responsible for any prohibited substance found in their system, regardless of intent, knowledge or fault. In effect, liability is imposed without the need to prove wrongdoing, meaning that accidental ingestion, contamination, or administrative error can still result in sanction.

Critics argue that this approach, while designed to preserve deterrence and enforceability, can produce outcomes that are perceived as disproportionate to an athlete’s actual level of culpability. Some go as far as stating that athletes can be punished despite not having the actual mens rea to take a prohibited substance: how can someone be punished if there was no intention? The result is a system in which the legal threshold for liability is low, but the personal and professional consequences are significant.

Athlete Impact

For athletes, sanctions extend far beyond suspension, often resulting in financial instability, psychological harm and social isolation, fundamentally altering their relationship with sport. As one athlete noted, “even after the ban there is often no path back,” with a 2026 Frontiers review similarly highlighting themes of isolation, perceived injustice and identity loss. Another  athlete observed that “the hardest part wasn’t the ban, it was losing my identity as an athlete.”

These impacts are reflected in practice, including cases handled by SLAM Global involving multi-year bans imposed on athletes operating within unfamiliar regulatory systems. In one case, a professional boxer received a four-year period of ineligibility following an adverse analytical finding, despite arguments of no intentional ingestion. However, applying the principle of strict liability under the Code, liability was established on the basis of presence alone, with no requirement to prove intent, resulting in a sanction notwithstanding the absence of moral culpability.

The case illustrates the rigidity of strict liability: intent is not a constituent element of the violation, meaning athletes may face career-altering sanctions based solely on the presence of a prohibited substance, regardless of subjective knowledge or intention.

Reform and Reaction

Fixing these issues is paramount and has prompted calls for reform. One proposed approach is to move towards a more explicit framework of culpability-based sanctioning, where the severity of punishment better reflects levels of fault rather than operating within rigid sanction bands. Alongside this, there are growing arguments for improved access to independent legal support for athletes and more effective multilingual education to ensure the system is genuinely accessible across jurisdictions.

These tensions are particularly significant given the scale of enforcement in major sporting events. The 2026 World Cup represents the largest anti-doping operation in football history, with FIFA coordinating confederations in Miami and partnering with USADA for the Club World Cup. However, this heightened enforcement effort coincides with wider political strain within the system, including the fact that the United States has not paid its WADA contributions since 2023. In addition, USADA has not been very complimentary of WADA and its practices in recent years, but nonetheless, the FIFA World Cup went without any controversy.  WADA has also considered proposals that could restrict officials from non-compliant countries attending major events, illustrating the extent of its regulatory reach even in politically sensitive contexts.

Taken together, these developments highlight a core tension within the principle of integrity: a system designed to protect fairness, but one that is increasingly questioned over whether its methods consistently deliver proportionate and defensible outcomes.

Openness

WADA’s Code of Ethics defines openness as trustworthy, respectful, impartial, objective, balanced, transparent and open to listening to the voice of others. It concerns the protection of fair competition, ensuring that sporting outcomes are determined by performance rather than prohibited enhancement. In essence, integrity is concerned with the fairness of the sport itself so that results produced on the field of play are legitimate and free from doping-related distortion. In practice, however, the increasing complexity of the system has raised questions as to whether openness, as a guiding value, translates into meaningful accessibility for athletes operating within it.

The complexity of the Prohibited List

A central feature of this framework is the Prohibited List, which is updated annually to reflect scientific and technological developments in performance enhancement. The list encompasses a wide range of substances and methods, from anabolic agents to gene-doping techniques, with recent updates including substances such as S-107 and ARM210, alongside the 2026 prohibition on carbon monoxide rebreathing as a method of increasing red blood cell production.

While the purpose of the List is regulatory clarity, its practical application is considerably more complex. Updates are issued in highly technical language, and frequently require translation and interpretation within already dense compliance frameworks.  The search has indicated that competitors often struggle to navigate key compliance obligations, with some describing aspects of the system as effectively “untranslated” and difficult to interpret in practice.  With the onus on athletes to ensure compliance, how is an athlete not blessed with a comprehensive educational background or coaching support, meant to understand the complex language of the list?

Whereabouts Regime

These challenges are compounded by the broader whereabouts regime. Athletes in Registered Testing Pools are required to submit quarterly whereabouts information, including a daily 60-minute time slot during which they must be available for testing. Failure to comply with these administrative requirements – three missed tests or filing failures within a 12-month period – may result in a sanction of up to two years, even in the absence of any adverse analytical finding.

Although the system is designed to ensure effective, unannounced testing, it has been criticised for placing significant administrative burdens on athletes. Strict liability applies equally in this context, meaning responsibility cannot be delegated to coaches, agents or support staff. FIFA has previously challenged aspects of this model, particularly the extent to which it requires constant monitoring of athletes’ personal time.  One could parallel this requirement akin to a released prisoner having to inform their probation officer of their whereabouts or face the prospect of punishment.  One must ask, is their really a need for such a strict whereabouts regime?

Controversies

Concerns around openness are further illustrated by historical and contemporary controversies that have impacted perceptions of consistency and transparency within the system. The Sochi 2014 Winter Olympics remains the most widely cited example of institutional failure, following evidence of state-enabled manipulation of doping controls, including the systematic tampering of samples. FSB agents swapping urine samples through a hole in a lab wall, approximately 100 dirty samples disappeared amidst the success of 13 Russian golds. The McLaren Report, an independent report released by professor Richard McLaren into the allegations and evidence of state-sponsored doping in Russia, later confirmed the existence of a state-run doping programme, resulting in sanctions against Russia’s Olympic Committee, although selected “neutral” athletes were still permitted to compete at subsequent Games.

More recently, WADA itself has faced scrutiny over its decision-making processes. In 2024, it emerged that 23 Chinese swimmers had returned positive tests for trimetazidine (‘TMZ’) in 2021 but were cleared following a contamination explanation accepted without independent external verification. This contrasted with the four-year sanction imposed on Russian figure skater Kamila Valieva for the same substance, prompting allegations of inconsistency in enforcement. US lawmakers responded with legislation threatening WADA’s $3.7m US contribution (8% of its budget); Michael Phelps testified that WADA’s position in relation to China would massively impact the Olympic movement.

The fallout extended beyond sport into geopolitics and governance. US lawmakers threatened to withhold funding from WADA, while the WADA accused critics of politicising anti-doping enforcement and pointed to deficiencies within other national bodies, including USADA. Academic commentary has since characterised the dispute as part of a broader geopolitical dynamic, framing anti-doping enforcement as increasingly entangled with state-level political tensions.  It is no secret that USADA has accused WADA of being outdated and not fit for purpose.

Taken together, these issues raise a fundamental question as to whether openness in the WADA framework reflects genuine transparency, or whether the increasing technical complexity and political pressure within the system have made meaningful accessibility more difficult to achieve in practice.

Excellence

WADA defines excellence as the maintenance of the highest scientific, operational and procedural standards in the global fight against doping, ensuring that the anti-doping system is effective, consistent and capable of responding to evolving methods of performance enhancement. In contrast to integrity, excellence is concerned not with the fairness of sporting outcomes, but with the quality and effectiveness of the system enforcing those outcomes. In practice, however, the pursuit of this standard is increasingly tested by structural and geopolitical pressures.

Detection Lag and Designer Drugs

WADA continues to face significant challenges in combating designer drugs, which are chemically modified to produce performance enhancements while evading detection. The central difficulty lies in the fact that anti-doping regulation is largely reactive rather than proactive. New performance-enhancing substances and methods frequently emerge before reliable testing methodologies can be developed, meaning that regulation is often implemented only after new substances are already in circulation. This creates a continuous “cat-and-mouse” dynamic, in which anti-doping authorities are engaged in an ongoing arms race against rapidly evolving synthetic compounds.

For example, erythropoietin (EPO), which increases red blood cell production and enhances aerobic capacity, is structurally very similar to naturally occurring EPO produced in the kidneys. Despite sophisticated detection techniques such as isoelectric focusing (IEF) and SDS-PAGE, identification remains technically complex, resource-intensive, and requires constant refinement of testing protocols. In addition, EPO has a relatively short detection window, as it can clear from the bloodstream and urine, sometimes within hours, enabling athletes to obtain significant physiological benefits while minimising the risk of detection. As a result, WADA increasingly relies on the Athlete Biological Passport (ABP) to identify indirect markers of doping; however, its effectiveness is dependent on consistent, longitudinal testing data and robust implementation across sporting jurisdictions.

Another example is human growth hormone (HGH), which has historically presented significant detection challenges due to its very short detection window despite producing long-term physiological benefits. The continuing difficulties associated with HGH detection were highlighted in 2026 when Olympic weightlifting medallist Yauheni Tsikhantsou was provisionally suspended following an adverse analytical finding for growth hormone. The rarity of confirmed HGH positives underscores both the technical sophistication required in modern anti-doping analysis and the persistent challenge of identifying substances that can deliver sustained performance gains within a narrow period of detectability.

Detection lag remains a structural limitation within anti-doping enforcement. Despite significant advances in scientific techniques and intelligence-led monitoring, the rapid emergence of novel substances continues to outpace regulatory development. WADA’s effectiveness depends not only on improving detection technologies, but also on strengthening adaptive, data-driven systems capable of responding to an evolving and increasingly sophisticated doping landscape.

Operational and Governance Challenges

Excellence also requires confidence in the operational integrity of testing systems. Scientific capability alone is insufficient if testing programmes are inconsistently implemented or vulnerable to manipulation.

On 30 April 2026, WADA announced the conclusion of Operation LIMS, which it described as the “most successful” anti-doping investigation in its history. The investigation utilised data recovered from the former Moscow Laboratory Information Management System (LIMS), enabling anti-doping authorities to uncover previously concealed anti-doping rule violations and impose 302 sanctions against 291 athletes across 22 sports. Its success lay in the ability to identify historical doping offences that had evaded traditional testing methods, demonstrating the growing importance of intelligence-led investigations and forensic data analysis in modern anti-doping enforcement.

Similarly, Operation Obsidian, a joint investigation by WADA and World Rugby, uncovered a coordinated urine-swapping scheme within the Georgian national men’s rugby team.  Following a four-year investigation, six players and the team doctor were sanctioned for attempting to conceal the use of recreational drugs and tramadol ahead of the 2023 Rugby World Cup. The case exposed vulnerabilities not in the scientific detection process itself, but in the administration and oversight of anti-doping programmes, illustrating that excellence depends as much on procedural compliance and institutional accountability as it does on testing capability.

Taken together, Operations LIMS and Obsidian demonstrate that excellence in anti-doping increasingly depends upon international co-operation, intelligence-sharing and advanced investigative techniques. As doping methods become more sophisticated, the ability of regulators to utilise forensic data analysis, coordinated investigations and robust governance structures will be essential to maintaining an effective and credible anti-doping system.

Evaluation

These developments demonstrate that WADA’s commitment to excellence remains under constant pressure. While advances such as the Athlete Biological Passport, intelligence-led investigations and increasingly sophisticated laboratory analysis have enhanced detection capabilities, anti-doping authorities continue to face a persistent lag between innovation in performance enhancement and the development of effective countermeasures. Consequently, excellence in anti-doping should not be viewed as a static achievement but as an ongoing process of scientific adaptation, regulatory reform and operational vigilance.

A new era of doping

In this article, we assess whether elite sport is now entering a new era of doping – defined not only by the substances being used, but by the increasing sophistication of methods designed to evade detection and test the limits of global regulatory systems.

Against the backdrop of the Enhanced Games and the growing normalisation of enhancement discourse, the focus is likely to shift from simply identifying new substances, to whether the global anti-doping framework can maintain coherence, credibility and enforceability in an environment where the boundaries of “doping” themselves are increasingly contested.
